Racing Tauranga Incorporated Terms and Conditions for Online Ticket Sales

These Terms and Conditions (Terms) apply to the online sale and purchase of tickets for events held at Tauranga Racecourse and to entry into the Venue. Please read these Terms carefully before purchasing a ticket or entering the Venue.

By purchasing a ticket, or entering the Venue, you agree to be bound by these Terms.

These Terms are to be read together with all other statements, directives, conditions of entry and terms displayed on or in connection with the ticket, our website, the relevant ticketing platform and at Tauranga Racecourse.

1. Definitions

1.1 In these Terms:

• Event means any event taking place at Tauranga Racecourse and includes a Meeting or Race.
• Force Majeure means any event beyond our reasonable control, including adverse weather conditions, war, acts of terrorism, civil disturbance, any order or act of a government, regulatory or governing body, disease, pandemic, epidemic, fire, flood, labour dispute, lockout, acts of a third party, and circumstances concerning the health or wellbeing of animals.
• Meeting means any race meeting held at Tauranga Racecourse.
• Race means any horse race forming part of a Meeting.
• Racing Tauranga means Racing Tauranga Incorporated (New Zealand Business Number 9429042592013), trading as Racing Tauranga, with its registered office at 1383 Cameron Road, Greerton, Tauranga, New Zealand. Racing Tauranga is also referred to as we, us and our.
• Ticket Holder or patron means any person who holds or uses a ticket or enters the Venue.
• Venue means Tauranga Racecourse, including its buildings, grounds, car parks and other areas controlled by Racing Tauranga.
• You and your mean the person purchasing a ticket through our website and, where applicable, any Ticket Holder or patron entering the Venue.

2. Payment, Ticketing and Card Fees

2.1

Ticket prices displayed on our website are in New Zealand dollars and include GST unless expressly stated otherwise. Your account will be charged in New Zealand dollars.

2.2

In addition to the advertised ticket price, ticketing, booking, administration, transaction, credit card or other payment-processing fees may be charged by the ticketing company and/or card-payment provider used to process the transaction.

These fees will be disclosed at checkout before payment is completed and are payable in addition to the advertised ticket price. They are determined and charged by the relevant service provider and may vary according to the ticket, transaction or payment method selected.

2.3

Delivery or courier charges may also apply where physical delivery is requested. Any applicable charge will be disclosed before the transaction is completed.

2.4

Accepted payment methods may include Visa and Mastercard and any other methods displayed at checkout.

3. Delivery

3.1

Once purchased, you may be able to elect for your ticket to be:

• Sent to your nominated email address;
• Couriered to your nominated physical address; or
• Collected in person from Racing Tauranga’s premises between 9.00 am and 4.00 pm, Monday to Friday.

Not all delivery options will be available for every ticket. Unless otherwise agreed, tickets cannot be collected from Racing Tauranga’s premises on the day of the Event.

3.2

Tickets will be deemed delivered when:

• Our email or ticketing system records that the electronic ticket has been sent;
• The ticket has been delivered to your nominated physical address; or
• The ticket has been collected from our premises, as applicable.

3.3

Photographic identification may be required when collecting a ticket. Unless otherwise approved by Racing Tauranga, only the cardholder or person who purchased the ticket may collect it.

4. Tickets and Conditions of Entry

4.1

By purchasing a ticket, you warrant that you are 18 years of age or older and are legally able to enter into the transaction.

Valid proof of age may be required to enter an Event or an age-restricted area. A person under 18 years of age may be denied entry unless accompanied by a parent or legal guardian, subject to the conditions applying to the particular Event or ticketed area.

If you are refused entry or removed from an Event because you are underage, do not have valid proof of age or have entered an age-restricted area, you will not be entitled to a refund, subject to your rights under applicable law.

4.2

Racing Tauranga accepts no responsibility for tickets that are misplaced, lost, stolen or damaged. Racing Tauranga reserves the right to charge a reasonable fee for issuing a replacement ticket.

4.3

Your ticket must be presented to Racing Tauranga or Event personnel upon request. Failure to do so may result in entry being refused or your removal from the Event.

Entry may be refused if the authenticity or validity of a ticket is questionable, including where the ticket has been damaged, altered or defaced, duplicated, cancelled, or obtained from an unauthorised source.

4.4

Additional conditions of entry may apply to a particular Event or area of the Venue.

Racing Tauranga and its authorised Event personnel reserve the right to refuse entry or remove any person from the Venue for reasons including:

• Misconduct or disorderly, dangerous or disruptive behaviour;
• Abusive, threatening or offensive language or behaviour;
• Intoxication;
• Possession of prohibited items;
• Failure to comply with applicable laws, liquor-licensing requirements or Venue rules; or
• Failure to follow the reasonable directions of Racing Tauranga, security or Event personnel.

If you are refused entry or removed for any of these reasons, you will not be entitled to a refund, subject to your rights under applicable law.

4.5

Your ticket provides admission to the Event and any additional benefits expressly stated as being included with that ticket.

Racing Tauranga reserves the right, at its discretion, to vary, add, withdraw, relocate or substitute advertised events, programmes, Meetings, Races, participants, seating arrangements, entertainment and facilities.

We do not guarantee:

• That any Event, Meeting or Race will take place;
• That any particular horse, jockey, performer or other participant will appear; or
• The nature or quality of any Event, Meeting, Race, entertainment or associated activity.

4.6

A ticket for a particular facility or hospitality area does not permit entry into any other private or restricted facility. Ticket Holders may access public areas, subject to the conditions applying to the Event.

Some facilities are outdoors or exposed to the weather. Unless otherwise advised, alternative facilities may not be available in the event of unfavourable weather.

4.7

Tickets may not, without Racing Tauranga’s prior written consent:

• Be resold or offered for resale at a premium;
• Be used for advertising, promotional or other commercial purposes; or
• Be included in a competition, package or hospitality offering.

A ticket sold or used in breach of this clause may be cancelled without refund, and the Ticket Holder may be refused admission.

4.8 Photography and Media

Photography, filming, audio recording and live broadcasting may occur throughout the Venue during an Event.

By entering the Venue, patrons acknowledge and consent to their image, likeness and/or voice being photographed, filmed, recorded or broadcast and used by Racing Tauranga, New Zealand Thoroughbred Racing and their authorised media, broadcasting, commercial and promotional partners for legitimate promotional, publicity, marketing, archival and coverage purposes, without compensation.

This material may be published or distributed through websites, social media, advertising, printed publications, television, livestreams and other media.

A parent or legal guardian accompanying a person under 18 years of age is responsible for that person’s attendance at the Venue.

Where reasonably practicable, a patron who does not wish to be the identifiable subject of promotional photography or filming should notify Racing Tauranga or the photographer at the time. This does not prevent incidental inclusion in crowd, background, raceday coverage or live-broadcast footage.

Unauthorised commercial photography, filming, recording or live broadcasting by patrons is prohibited unless Racing Tauranga has given prior written approval.

4.9

The person purchasing tickets on behalf of others is responsible for making the other Ticket Holders aware of these Terms and any additional conditions applying to the Event.

5. Refunds

5.1

If you are a consumer as defined in the Consumer Guarantees Act 1993, nothing in these Terms limits or excludes any rights or remedies you may have under that Act or any other applicable law.

5.2

Subject to clause 5.1 and to the maximum extent permitted by law:

• Any representations or warranties implied by law are excluded; and
• Our liability in respect of any ticket or Event is limited to the ticket price paid to Racing Tauranga.

Unless required by law or expressly agreed otherwise, any refund will exclude ticketing, booking, administration, transaction, credit card, payment-processing, courier and other third-party fees.

Racing Tauranga will not be liable for any other costs or losses incurred as a result of an Event being cancelled, abandoned, relocated or postponed, including travel, accommodation or incidental expenses.

Refunds will only be issued to the original purchaser and, where practicable, through the original payment method.

5.3

To the maximum extent permitted by law, Racing Tauranga will not be liable where it is unable to perform its obligations under these Terms due to Force Majeure.

If an Event, or any part of an Event—including a Meeting or Race—is cancelled, abandoned, interrupted or postponed due to Force Majeure, Racing Tauranga is not required to provide a refund, credit or exchange or to arrange a substitute Event, Meeting or Race, except where required by applicable law.

5.4

No refund will be provided if you are unable or choose not to attend an Event, except where required by applicable law or expressly agreed by Racing Tauranga.

6. Miscellaneous

6.1

We may vary these Terms from time to time. Any variation will apply to ticket purchases made, and Events entered, after the updated Terms have been published.

6.2

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

6.3

These Terms are governed by New Zealand law, and the parties submit to the exclusive jurisdiction of the courts of New Zealand.
